新规一出,华裔老人吓得纷纷放弃养老金

自去年8月27日后,联邦就业和社会发展部改用全新的老人保障金和保证入息补助金的申请表格,很多华裔老人被吓得连老人金都不敢申领。


全新的老人保障金(Old Age Security Benefits,OAS)和保证入息补助金(Guaranteed Income Supplement,GIS)的申请表格,是将原本分开的老人保障金和保证入息补助金的申请表格合二为一。

但新的申请表格要求申请人填写其在原居地的身分证号码及申报全球收入,一些华裔耆老移民害怕自己过往多年来未申报海外收入而被联邦税务局追讨欠税,最终决定放弃申请。

要填原居地身分证号码

一家志愿机构过往一直协助不识英语的华裔耆老填表申请老人保障金和保证入息补助金,其中一名女职员说,从去年8月27日开始,老人保障金的申请表格有所更改,从原先的4页纸增加至7页纸,但申请人毋需另外填写保证入息补助金的申请表格。

女职员说:"从8月27日开始,填好新的申请表格后,只要申请人符合领取保证入息补助金的资格,将会自动获得,毋需像过往一样另行填表申请。"

但上述全新的申请表格增加了要求申请人填写其在原居地的身分证号码,并要申报全球收入的内容,以便联邦政府能根据申请人在原居地的身分证号码,调查其是否拥有在加国以外的其他国家的收入。

她说:"申请人在填写表格时要自行申报来自其他国家的收入,包括退休金、养老金和租金等。至于申请人的配偶是否在原居地有收入,也要申报,之后必须在签名一栏,宣誓自己填写的信息全部是真实的。"

女职员透露,自从增添了此部分内容后,不少原计划申请上述两项福利的华裔耆老移民已决定放弃,前来寻求帮助填写申请表格的人数也明显减少。

这些华裔耆老绝大多数是通过家庭团聚的途径,在子女担保下从中国大陆移居加国的,他们在加拿大已住满了10年,很多人在原居地依然领取金额可观的退休金和养老金,有的还拥有房产,有房屋出租的收入和其他投资收入。

正因如此,如果他们填写了原居地的身分证号码,联邦政府可以很容易根据银行资料查出他们的收入情况,无疑是将自己暴露了。

她说:"很多人可能已连续10多年在报税时没有申报过自己的海外收入,他们害怕在申请表中填写了原居地的身分证号码后,联邦税务局追讨欠税,甚至被控诈骗和逃税,那还不如自动放弃申请。"

据她所知,华裔耆老申请老人保障金和保证入息补助金被拒的个案不乏少数,甚至有人被追讨已领取的老人保障金和保证入息补助金,追讨金额高达数万元。她还听闻有人在被政府追讨已发放的老人保障金和保证入息补助金后,一走了之离开了加拿大不再回来。

她说:"申请人在提交了老人保障金和保证入息补助金的申请表格后,通常会在3周至3个月内获批。如果等待审批的时间愈长,说明问题可能愈多。"

Guaranteed Income Supplement – Overview

The Guaranteed Income Supplement (GIS) provides a monthly non-taxable benefit to Old Age Security (OAS) pension recipients who have a low income and are living in Canada.


Guaranteed Income Supplement – Eligibility

You qualify for the GIS if you meet all of the following conditions:

Using your income information from your federal Income Tax and Benefit Return, we will review your eligibility for the GIS every year. If you still qualify, your benefit will be automatically renewed. In July, you will receive a letter telling you:

  • that your benefit will be renewed;
  • that your benefit will be stopped; or
  • that your income information is required.

You were selected for automatic enrolment for the Old Age Security pension and the Guaranteed Income Supplement

If you were automatically enrolled for the OAS pension, you will be automatically enrolled for the GIS if you are eligible. If so, you will be considered for the GIS on an annual basis, without needing to apply. If you can be automatically enrolled, Service Canada will send you a notification letter the month after you turn 64.

If you did not receive a letter from Service Canada informing you that you were selected for OAS/GIS automatic enrolment, you must apply in writing. Complete and mail the Application for the Old Age Security Pension and the Guaranteed Income Supplement (ISP-3550) to the appropriate address listed on the last page of the application.

If you are already in receipt of the OAS pension but do not receive the GIS and want to apply, complete the Application for the Guaranteed Income Supplement (ISP3025).

How to delay receipt of the GIS

You may decline automatic enrolment for the GIS by:

  • accessing your My Service Canada account and following the directions; or
  • signing and returning the automatic enrolment letter by mail.

Sponsored immigrants

If you are a sponsored immigrant and you have resided in Canada less than 10 years after age 18, you are not eligible to receive an OAS income-tested benefit (the GIS, the Allowance or the Allowance for the Survivor) during your sponsorship period unless your sponsor:

  • suffers personal bankruptcy;
  • is imprisoned for more than six months;
  • is convicted of abusing you; or
  • dies.

Non-sponsored immigrants

If you are a non-sponsored immigrant, you may be eligible to receive the GIS based on the number of years you have resided in Canada after age 18.

If you have lived in Canada for fewer than 10 years since you turned 18, but you have lived or worked in a country that has a social security agreement with Canada, you may be eligible for a partial benefit. Your GIS entitlement will gradually increase with every year that you continue to reside in Canada until you have reached 10 years of residence. Guaranteed Income Supplement – How much could you receive

The amount of the GIS you receive depends on your marital status and your previous year's income (or in the case of a couple, your combined income).

Consult the table of Old Age Security pension and Guaranteed Income Supplement amounts for current benefit rates.

Note:

Couples who are forced to live apart for reasons beyond their control (such as a requirement for long-term care for one or both of you) may be eligible to receive higher GIS or Allowance benefits based on their individual income.

To be eligible, you must advise Service Canada in writing by submitting the Statement – Spouses or Common-law Partners Living apart for Reasons Beyond their Control (SC ISP-3040) explaining your living situation, and indicating the date that you and your spouse or common-law partner were first forced to live apart.

Sources of income and deductions

When applying for the Guaranteed Income Supplement and the Allowance, you, or in the case of a couple you and your spouse or common-law partner, must report your income and deductions.

Use the information slips issued to you for income tax purposes, as well as your federal Income Tax and Benefit Return, to report the following income and deductions:

  • Canada Pension Plan (CPP) or Quebec Pension Plan (QPP) benefits
  • other pension income, such as private pensions, superannuation and foreign pension income
  • Registered Retirement Savings Plans (RRSPs) that you cashed during the year
  • Employment Insurance benefits
  • interest and other investment income
  • capital gains and taxable Canadian dividends
  • net income from any rental properties
  • net employment income minus the following deductions:
    • your CPP or QPP contributions, your Employment Insurance premiums, and the $3,500 earnings exemption
  • net self-employment income minus the following deductions:
    • your CPP or QPP contributions on self-employment, and your Employment Insurance premiums
  • other income from sources such as workers’ compensation payments and alimony; and
  • other deductions, such as union dues, RRSP deduction, moving expenses and other employment expenses

Note:

The Old Age Security pension, the Guaranteed Income Supplement, the Allowance and the Allowance for the Survivorare not included as income for OAS income tested benefits.

Guaranteed Income Supplement – What you need before you start

You can apply for this benefit at various times depending on your situation.

You are already receiving your Old Age Security pension

If you are already receiving an OAS pension, you should apply for your GIS as soon as possible so you don’t lose any payments (we may be able to give you a retroactive payment for up to a maximum of 11 months from the date we receive your application).

You have not yet applied for your Old Age Security pension

In April 2013, Service Canada implemented a process to automatically enroll seniors who are eligible to receive the OAS pension. In December 2017, automatic enrolment was expanded to include the GIS.

If you can be automatically enrolled, Service Canada will send you a notification letter the month after you turn 64.

In deciding when to apply for your OAS pension, consider your personal financial situation as well as the following scenarios, if they apply to you.

If you did not receive a letter from Service Canada informing you that you were selected for automatic enrolment, you must apply in writing for the OAS pension. Complete and mail the Application for the OAS and the GIS (ISP-3550) to the address listed in Returning the form.

You were unable to apply when you became eligible

If, due to a medical condition, you were unable to apply earlier or to ask someone to apply on your behalf, please contact us to obtain the Declaration of Incapacity form. If you meet all of the eligibility requirements, completing and returning this form may allow you to receive your pension with an earlier start date.

Can someone else contact Service Canada on my behalf

You can authorize a person to give information to and receive information from Service Canada on your behalf by signing in to My Service Canada Account (MSCA) or by completing the Consent to Communicate Information to an Authorized Person form (ISP1603CPP) and mailing it to the Service Canada office mentioned on the page Returning the form.

This form does not provide authority for the person to apply for benefits on your behalf, change your payment address, or request or change the withholding of tax.

If an individual is incapable of managing his or her own affairs, another person or agency (for example, a trustee) may be appointed to act on the individual’s behalf.
