Department of Justice Office of Public Affairs FOR IMMEDIATE RELEASE Thursday, August 9, 2018 Real Estate Investor Pleads Guilty to Bid Rigging at Online AuctionsReal estate investor Christopher Graeve pleaded guilty today in West Palm Beach, in connection with an ongoing investigation into bid rigging at online public foreclosure auctions in Florida, the Department of Justice announced. Graeve is the second real estate investor to plead guilty in this investigation. Felony charges of bid rigging were filed against Graeve on November 2, 2017, in the U.S. District Court for the Southern District of Florida. According to court documents, from around January 2012 through around June 2015, Graeve conspired with others to rig bids during online foreclosure auctions in Palm Beach County, Florida. “Real estate investors who deal in foreclosed properties should be on notice that the Division will not tolerate the subversion of competition in foreclosure auctions,” said Assistant Attorney General Makan Delrahim of the Department of Justice’s Antitrust Division. “The Division will continue to prosecute antitrust violations that occur at these auctions, and will hold individuals who engage in this conduct accountable.” “Real estate investors who think they can swindle the system to line their pockets with ill-gotten gains beware,” said Special Agent in Charge Robert F. Lasky of the FBI Miami’s Field Office. “The FBI and our law enforcement partners will vigorously investigate such schemes.” The Department said that the primary purpose of the conspiracy was to suppress and restrain competition in order to obtain selected real estate offered at online foreclosure auctions at non-competitive prices. When real estate properties are sold at these auctions, the proceeds are used to pay off the mortgage and other debt attached to the property, with any remaining proceeds available to the homeowner. According to court documents, the conspiracy artificially lowered the price paid at auction for such homes. In the past several years, the Division and its law enforcement partners have secured convictions of more than 100 individuals for rigging public mortgage foreclosure auctions in six different states, including Florida. The investigation is being conducted by the Antitrust Division’s Washington Criminal I Section and the FBI’s Miami Division – West Palm Beach Resident Agency. Source: https://www.justice.gov/opa/pr/real-estate-investor-pleads-guilty-bid-rigging-online-auctions 7/29/2018 今年58岁的华裔男子陈喜林(Xilin Chen),在6年前入籍美国时,没有想到自己会落到今天这步田地:美国公民身份被撤销,多栋豪宅被没收,420万美元(约2816万人民币)的财产充公,一贫如洗的他只能拿着一纸遣返令灰熘熘地回中国。 ![]() 2018年7月16日,美国检方表示,陈喜林将被剥夺美国公民身份,他将在家中监禁12个月,然后被遣返送回中国。 陈喜林在法庭上称,自己在中国的老母亲身体状况不容乐观,恐怕不久于世,请求法官允许他回国两个星期,看母亲最后一眼。 这一请求被法官当庭回绝。 ![]() 陈喜林是从中国广东移民到美国的。表面上,他只是个做小生意的华裔老闆,在美国洛杉矶的时装一条街经营着两家内衣店。 陈喜林名下的旖丽内衣(Yili Underwear,音译)和高雅美内衣(Gayima Underwear,音译)平日里门庭冷落,生意并不兴旺,连店外的招牌都已经鏽迹斑斑。 ![]() 不过,来美多年后,陈喜林还是在2012年成功拿到了美国公民的身份。那一年冬天,他花115万美元买下了一栋坐北朝南、面积超过9000平方英尺的5卧豪宅。这栋豪宅的市价目前已经翻倍,但跟陈喜林一家没什麽关係了,因为美国警方已经将这栋宅子没收充公。 ![]() 根据陈家的邻居介绍,陈家人很谦和,但是从不和邻居们来往,可能是因为陈家长辈不会说英语的缘故。整个陈家上下,老老小小近10口人,但邻居并不清楚他们之间的确切关係。邻居也表示,平日里经常看到陈家人开着白色的宝马、凌志等豪车进出宅邸。 2014年9月,多名邻居目睹了大量全副武装的警察冲进陈家豪宅,将陈喜林和他24岁的儿子陈创丰(Chuangfeng Chen)逮捕,指控他们涉嫌为墨西哥毒枭洗钱。 毒贩子将毒品变卖的钱,大量购买陈喜林店裡的内衣,再把这些内衣运往另一个国家销售,得到的资金再交付给贩毒组织。 2013年9月18日,陈锡林和陈爱霞从假扮毒贩的联邦探员手中收取现金10,625美元,并开出两张金额小于1万的假髮票,以逃避填写申报表。自此落入警方圈套。 ![]() 同时被指控的还有陈喜林28岁的女儿陈爱霞(Aixia Chen),但是她在警察抓人前已经逃回了中国,警方随即展开对她的通缉追捕。 陈喜林的另外4处房产也遭到了警方的调查。其中一栋5卧双层豪宅遭到搜查时,租住着1男4女5名中国留学生。租住的留学生表示,听到陈氏父子因涉嫌洗钱被逮捕的消息感到很吃惊,得知房子不能再住了,他们想向陈喜林要回租房的押金,但却联繫不上他。 陈家一栋拥有4个卧室、泳池、篮球场、乒乓球室的双层豪宅也被没收。 ![]() 案件审理到今天,近4年过去了,陈喜林从一开始的否认指控,到现在终于低头认罪。在认罪协议裡,陈喜林愿意放弃名下的两栋豪宅物业、一栋商业大楼,并放弃自己的美国公民身份,以求检察官撤回对女儿陈爱霞的起诉。 在认罪协议中,陈喜林承认他曾三次接受过冒充毒贩的FBI用麻醉品贩运的所得付给他的大量服装款。另外,陈喜林还将进口商品透过向海关递交假的货物价值信息,将价值为17万5535美元的商品,说成8万6635美元,以此减少关税。他25岁的儿子陈创丰也承认曾用假证件通过海关。 据报导,陈喜林的两个孩子都是名校毕业的精英,儿子陈喜林毕业与纽约着名私立高校雪城大学,女儿陈爱霞则毕业于鼎鼎大名的加州大学伯克利分校。不敢相信,两个名校毕业的大学生,就这样被拉下了水… … 陈喜林和儿子陈创丰将在8月15上法庭接受最终宣判。 5/27/2018 ![]() 一位和冯曾经有过司法纠纷的华裔男子扶东星在庭外受访时称,对这个结果表示非常失望。(记者李╱摄影) 一名华裔妇人因为参与围标(Bid Rigging)拍卖,串通他人因而低价拍得大量房地产物业,25日(周五)在旧金山联邦法庭被判处45天监禁,服刑结束后还要监守行为(Supervised Release)为期两年,完成400个小时的社区服务令,并交付罚款14万5000元。 名为Florence Fung(音译冯姓)的女子,在2009年和2010年期间,曾经收受他人钱财而放弃投标拍卖。随后更是用同样的方式买通他人放弃投标,因而自己拍得数十栋的物业。如今冯名下有45个房地产物业。 宣判结束之后冯姓女子与律师均拒绝接受媒体采访。检方提出的建议量刑是八个月,最终法官轻判了45天监禁。当天被判刑的还有另外参与围标的人,一名同样参与围标的男子,检方的建议量刑则是七个月,最终法官判处30天监禁。 检方人员在法庭上一直强调,必须要向外界发出一个信号,就是参与围标是会坐牢的,达到警示的作用。 一名和冯姓女子曾经有过司法纠纷的华裔男子扶东星在庭外受访时称,对这个结果表示非常失望。他透露,自己曾经是帮助冯装修屋子的合同方,后来双方因为款项纠纷而诉诸法庭。虽然自己的案子和围标案无关,但是扶仍然提交了文件给法官,希望判冯最大的刑期。 他认为,冯姓女子当初通过围标拿下的数十栋物业,如今湾区房价飞涨,每一栋都可能超过百万。他表示冯利用违法手段只需要坐45天的牢,却换来了千万的身家。 Published on Mar 23, 2012 Bid rigging - is an illegal pricing practice in which firms that are tendering for the supply of an item collude in order to maintain high prices for their products or to share work between them. | HAN, Liu, CPA | 韩柳 President, Principal Loan Consultant, Leader Funding, Inc. 电话: (240) 784-6645 Rockville, MD Phone: 301-366-3497 |
