5/13/2018 美国对于移民和非移民都越来越不待见 最近又把矛头指向 留学生和交换学者 美移民局新规: 留学生及学者非法居留将定为非法并严惩 ![]() 政策公布时间:2018年5月11日(本周五) 政策生效时间:2018年8月9日 主要涉及人群: 美学生、交换访问者 涉及哪些签证类型: 学生签证(F1、F2) 交换学者签证(J1、J2) 短期学习签证(M1、M2) ![]() 2018年8月9日前,下面情况满足任何一项被判定为非法居留: -如果美国国土安全部在当事人申请其他身份期间,裁定当事人违反非移民规定,并拒绝授予移民身份的次日起-I-94过期后的第二天起-在移民法官或移民上诉委员会(BIA)的命令驱逐或移除(无论上诉是否上诉)。 ![]() 2018年8月9日起,超过下面日期将被判定为非法居留,并以最早时间为准: -当事人不再进行学习或授权活动后的第二天,或他们从事未经授权的活动后的第二天; -完成课程或课程后的第二天,包括任何授权的实践培训加上任何授权宽限期; -I-94到期后的第二天在移民法官或移民上诉委员会(BIA)命令将他们排除,驱逐或移除(无论该决定是否上诉)。 逾期滞留的后果: 单次滞留超过180天,出境后3年或者10年都不能再次入境,具体时间取决在美滞留的天数。 累积超过一年非法存在期限的个人(无论是单次还是多次累积),如果还想非法入境,将会被拉入终身不得入境的黑名单。 如果三年,十年或永久非法入境的人,一般不符合申请入学或永久居住地签证,除非他们有资格获得豁免。 留学生成滞留大户,他们这样“黑”在美国 移民局向留学生开刀,也是因为留学生黑在美国的不在少数。据《华盛顿邮报报道》,在140万在美留学生和交换学者中,逾期滞留占2.8%,成为各类签证中逾期滞留的大户。 ![]() 美国联邦移民和海关执法局官员表示,有一部分人一拿到签证就“消失”了,根本就没去学校报道。 FIB钓鱼执法虚假大学被一锅端 2016年住在南加的L小姐7日中午还在上班的时候,突然受到了来自美国移民局的信件,被告知身份被终结了。 ![]() L小姐表示她来美国四年了,2013年毕业于加大(UC)系统中的一所公立大学,因为H1B没有被抽中,无奈之下才决定选择一所学校挂靠。 她起先在2014年找了圣何塞San Jose的一家学校挂靠,当时一年的学费为1万2000元,一年后在2015年9月找到了一位留学中介代理李先生,在他的介绍下挂靠到了“北新泽西大学”,每年的学费为1万3500元,就在两周前她才刚刚交了6000元的学费,没有想到立刻就被打成了“黑户”,就连学费也打了水漂。 FBI演戏三年办假大学“钓”挂靠学生,11名华人被捕,虚拟大学“北新泽西大学”挂靠CPT的大量留学生身份(F-1)已被终止,一些已经被移民局约谈的学生护照也被没收,暂时不能离境。有学生受到法院传票..... ![]() 挂靠学生在美之路终结 除了加州外,纽约也未能幸免,居住在纽约上州的留学生张强(皆为化名)表示,他去年5月研究生毕业前一个月已找到工作,并递交H1B工作签证申请,不幸未被抽中。因为这是他第二个硕士学位,OPT在2012年第一个硕士毕业时已经用过。为保住身分,张强2015年8月通过中介申请北新泽西大学,“当时中介告诉我,可以上课,也可以不上课,我其实是想边上课、边工作”。 张强回忆,“5日早8时多,四名移民局工作人员来敲我家门,开门后先问我什么身分,并让我拿出护照,然后请我去美国移民大楼面谈,移民官员问了些关于该大学的事情和我个人的基本信息,问话时间大约一小时”。他当时还看到几名中国人和印度人也被约去问话。 张强表示,“问话结束前,移民局官员收走了我的护照,并告知我的学生身分已被终止,暂时不能回国,还给我一张上庭通知单,时间、地点未定”。 ![]() 逾期滞留的代价太大,永远不要挑战移民局搜查能力和遣返的执行力! 5/12/2018 美国公民与移民局(USCIS)官网11日发佈了政策备忘录,对计算持有F、J和M非移民签证的学生和访问学者非法逗留时间规则做了新的调整。 据USCIS官网报道,这项将于8月9日生效的新政,将与由总统签署的加强美国国内公共安全(Enhancing Public Safety in the Interior of the United States)的行政令一道,共同辅助美国移民法律的执行。 USCIS主任弗朗西斯•西斯纳(Francis Cissna)表示:“这个信息很明确,即这些非移民人士不能在签证到期后或是在违反签证规定的情况下非法在美国境内逗留。” 新政策规定,未能在2018年8月9日之前延期F、J和M签证的人士,自8月9日起在美国境内的逗留天数将被累积计入非法逗留时间,之前已被计入非法逗留时间或有以下情况的除外: —自国土安全部否认提供移民福利起,如果国安部发现,某个人已违反其非移民身份,并且新的移民福利正在申请当中的; —自I-94签证过期起; —自移民法官或在某些情况下,自移民上诉委员会(Board of Immigration Appeals )发佈除外、驱逐或移除命令起(无论是否决定上诉); 自2018年8月9日起(包括8月9日当天),未能继续保留其逗留身份的F、J和M签证持有人的非法逗留时间将在以下情况下开始累积: —自他们的学业或经授权的工作结束之日起,或自他们加入未经授权的工作之日起; —自他们的学业或项目完成之日起,包括任何经授权的实践培训以及任何经授权的宽限期限; —自I-94签证过期起; —自移民法官或在某些情况下,自移民上诉委员会(Board of Immigration Appeals )发佈除外、驱逐或移除命令起(无论是否决定上诉); 非法逗留时间单次入境内已累积至180天以上并离开美国者,可能将被处以3年或10年的入境等待,具体将根据离境前累积的非法逗留时间定夺。非法逗留时间(包括单次入境或多次入境)累积至1年以上并在未经允许或假释的情况下再次进入或试图再次进入美国境内者,将永远不能获得入境批准。 入境等待时间为3年或10年,或永远不能获得入境批准者,除被收回永久不能入境身份或接到其他豁免资格,一般情况下将无法申请签证、入境申请或调整永久居留权。 USCIS接受针对此项政策备忘录的评论。公众评论时间为2018年5月11日至2018年6月11日。 5/11/2018 WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) today posted a policy memorandum (PDF, 179 KB)changing how the agency will calculate unlawful presence for students and exchange visitors in F, J, and M nonimmigrant status, including F-2, J-2, or M-2 dependents, who fail to maintain their status in the United States. This policy aligns with President Trump’s Executive Order: Enhancing Public Safety in the Interior of the United States to enforce the immigration laws of the country and will go into effect on Aug. 9, 2018. “USCIS is dedicated to our mission of ensuring the integrity of the immigration system. F, J, and M nonimmigrants are admitted to the United States for a specific purpose, and when that purpose has ended, we expect them to depart, or to obtain another, lawful immigration status,” said USCIS Director L. Francis Cissna. “The message is clear: These nonimmigrants cannot overstay their periods of admission or violate the terms of admission and stay illegally in the U.S. anymore.” Individuals in F, J, and M status who failed to maintain their status before Aug. 9, 2018, will start accruing unlawful presence on that date based on that failure, unless they had already started accruing unlawful presence, on the earliest of any of the following:

Individuals who have accrued more than 180 days of unlawful presence during a single stay, and then depart, may be subject to three-year or 10-year bars to admission, depending on how much unlawful presence they accrued before they departed the United States. Individuals who have accrued a total period of more than one year of unlawful presence, whether in a single stay or during multiple stays in the United States, and who then reenter or attempt to reenter the United States without being admitted or paroled are permanently inadmissible. Those subject to the three-year, 10-year, or permanent unlawful presence bars to admission are generally not eligible to apply for a visa, admission, or adjustment of status to permanent residence unless they are eligible for a waiver of inadmissibility or another form of relief. This policy memorandum is updating Chapter 40.9.2 of the USCIS Adjudicator’s Field Manual. USCIS is accepting comments on the policy memorandum. This new effort improves the way the agencies share information, collaborate on cases, and train each other’s investigators. The MOU will increase the ability of the agencies to share information and help identify, investigate, and prosecute employers who may be discriminating against U.S. workers and/or violating immigration laws. In 2010, USCIS and the Justice Department’s Civil Rights Division entered into an ongoing partnership to share information about E-Verify misuse and combat employment discrimination, and today’s MOU expands upon the two agencies’ existing partnership. In 2017, the Civil Rights Division launched the Protecting U.S. Workers Initiative, which is aimed at targeting, investigating, and taking enforcement actions against companies that discriminate against U.S. workers in favor of foreign visa workers. Under this Initiative, the Civil Rights Division has opened dozens of investigations, filed one lawsuit, and reached settlement agreements with two employers. Since the Initiative’s inception, employers have agreed to pay or have distributed over $200,000 in back pay to affected U.S. workers. The Division has also increased its collaboration with other federal agencies to combat discrimination and abuse by employers using foreign visa workers. USCIS administers the nation’s immigration system and adjudicates requests for immigration benefits, including employment-based petitions. To advance the goals of the Buy American and Hire American Executive Order and promote the economic interests of U.S. workers, USCIS is taking concrete steps to ensure the integrity of the employment-based immigration programs and improve its ability to detect and prevent fraud. Among other things, USCIS has created dedicated tip lines for reporting H-1B and H-2B visa fraud and abuse, and expanded its site visit programs. USCIS has also worked with other government agencies that have a role in immigration, such as DOJ, to ensure that they efficiently share and appropriately act upon information regarding potential fraud and abuse of immigration programs.
